Why protection for plants is require in  India? 

Being a member of WTO ( World Trade Organisation) and signatory of TRIPS (Trade Related Aspects of Intellectual Property Rights) it's mandatory for India to provide protection to plant varieties either by patent Or by sui generis Or both. India exercised sui generis option for protection of plant and plant varieties. 

The Sui generis system means for effective protection of plant varieties, India enacted "The Protection of Plant Varieties and Farmers Rights ( PPVFR) Act on August 9 2001 for plant variety protection by Lok Sabha. 

This system attempts in recognizing and protecting the rights of plant breeders and farmers. As they contribute in conserving, improving and making available available plant Genetic resources for future research and development of new plant varieties. 

This helps in improving the agricultural development and stimulates investment for research and development for the development and release of new varieties which in turn facilitates the growth of seed industry and ensures the availability of high quality seeds and plant materials to the farmers. 

Objectives:

1. To establish an effective system for the protection of plant. 

2. To recognize and protect the rights of Farmers. 

3.  To accelerate agricultural development in the country.

4. To enhance the growth of seed industry in the country. 

General functions:

1. Registration of new plant varieties, Essentially Derived Varieties ( EDV) and extant varieties. 

2. Developing DUS (Distinctness, Uniformity, Effectiveness) test guidelines for new plant species. 

3. Maintenance of the National Register of plant varieties and National Gene Bank. 

4. Cataloguing facilities of all varieties . Documentation, indexing and rewarding the farmers particularly who are engaged in conservation, improvement and preservation. 

What is PVP? 

Legal protection of a plant variety to a breeder in tha form of Plant Breeder's Rights(PBR). 

PBR are intellectual property rights that provide exclusive rights to a breeder of the registered variety. 

Who can apply for the registration of a plant variety? 

Person claiming to be breeder of the variety or his successor. 

A farmer or a group of farmers claiming to be the breeder of the variety. 

Where to file the application? 

For this PPV and FR Act, 2001 , Protection of Plant variety and Farmer's Rights Authority was established in oct 2005. 

Head quarter- New Delhi

The 2 branch offices are located at

1. Assam Agricultural University, Khanapara, Guwahati . 

2. Birsa Agricultural University Campus, Ranchi. 

Registration of plant variety:

Filling the application with all the required details along with registration fees nearly Rs. 5000 to 10000 depending on the type of the applicant either individual or educational or commercial. Then browsing for preliminary examination. If all the information are proper, Acknowledgement receipt is issued. 

Further an unique number will be alloted according to the list sorted. Then DUS fee and seeds are asked to be submitted for further process. If it's in accordance of the data provided by the applicant. 

Then the registration is done and the certificate is granted. 

Note: Protection 15yr (6+) for other than tree and 18yr(9+) for tree and wine.

Totally 18 species can be registered under this:

Cereals - RICE, WHEAT, MAIZE, SORGHUM, PEARL MILLET

Pulses - CHICKPEA, MUNG BEAN, URD BEAN, FIELD PEA, RAJMA, LENTIL, PIGEON PEA

COTTON, JUTE 

Some Others are MANGO, MUSTARD, RAPESEED, LINSEED, SESAME, SUNFLOWER, SOYABEAN etc.,
